This Term of Use shall come into force immediately when you (website users, customers or car dealers) enter the Website www.carhero.co.th ("Website"). Please note that you must comply with all the conditions stated herein while using the Website.
Please note that all contents or information appearing on the Website are the proprietary of Car Hero Company Limited (hereinafter referred to as “Car Hero” or “Company”) who is legally entitled to or is granted the license to use such the contents or information legally, including but not limited to copyright, trademark and any other intellectual property rights of the texts, images, photographs, designs, whether in whole or in part. The Company reserves the exclusive right to use, collect, reproduce, transfer, share, publish, download or proceed with the contents on the Website by any other means. The Company may take legal action against any person who uses such contents on the Website without a prior written consent from an authorized person of the Company. The Company reserves the right to be released from any liabilities in case that you are prosecuted by a third party due to the use of any information or contents on the Website without prior consent of the Company or a third party who is the proprietor of such contents.
Car Hero shall not be responsible for any damage that may occur from the use of the Website to your computer devices and any other property, and it shall be deemed that you voluntarily use the Website at your own’s risks.
You will not access or attempt to access the system (whether there are any protection measures provided or not) in order to use, change, reproduce, modify, delete or destroy the contents or operations of the Website for whatsoever reasons. You shall not attempt to insert or upload any falsified information into Car Hero’s Website for whatsoever reasons.
You will not falsify or attempt to impersonate any other person and will not disguise your identity while using the Website with a purpose of committing any offenses prohibited by the laws. You shall not use the Website for defaming, damaging or harassing Car Hero or a third party in any circumstances.
You shall refrain from taking or attempting to take any actions that may restrain or overload the operation of Car Hero’s Website in any circumstances.
You shall not use any instruction sets, computer programs, including any computer viruses, malware, or similar computer software/instruction sets that may damage the Website’s usage or pose any impacts on other users
The Company reserves its exclusive rights to change any information and contents of the Website at any time without prior notice on a case-by-case basis. You must verify and read the contents thoroughly at any time before using and proceeding to any booking/buying/selling transactions with the Company. In case of any doubts or questions on a message or content, please contact the Company's staff via recommended channel(s) before confirming the transactions with the Company.
The Company will provide the information of each item in accordance with the current information. However, please note that the contents of products are dynamic all the time (e.g. age, mileage or condition, etc.). The Company shall not confirm the accuracy of such content until the Company sends you a confirmation of booking/purchase transaction in writing via email or registered mail.
In case of a dispute between two or more customers regarding the right to book/buy the same car, the final decision shall be subject to the Company’s sole and absolute discretion. The Company shall not be liable for any direct or indirect interests, penalties or damage (including, without limitation, loss of business opportunity, profits, or damages for failure to perform an obligation to a third party, etc.) arising out of the rejection/cancellation of the booking for any circumstances. The Company shall only be responsible for refunding the booking/deposit payment to the customer (provided in case that the customer is eligible to obtain the refund for the booking/deposit payment in accordance with the conditions permitted by the booking/purchase agreement or as permitted by the laws).
